OUR SERVICES
CONVEYANCING AND PROPERTY LAW
Providing advice when buying or selling property- For most of us, buying a property is one of the most significant investments we’ll make in our lives. Our team guides clients through the necessary compliance and investigative steps necessary to de-risk the transaction for them. We identify, recommend and carry out all of those matters to properly advise our client and complete the conveyance of the property. Understanding property, means that we know our way around easements, encroachment issues and title structures such as strata by-laws and the community management statements that are recorded on title, and building management statements for certain types of mixed use assets. We can explain those for you and identify the elements that could impact on your use of your property.
- We’re here to make sure you are informed, protected and that the transaction proceeds smoothly and on time. Our team is always available to speak with you before and during the process.
- We can assist with:
- Off-the-plan or existing properties
- Properties in a community titles scheme (Strata). We have a broad understanding of the BCCM laws, and the ability to deal with leases and licences (telco, crane oversail, underpinning, commercial agreements, changes to lot and title configurations and structures.
- Ordinary freehold or State leasehold
- Residential, commercial, retail or industrial
- Seller Disclosure statements

Protecting your family's future- Our Wills and Estates team will provide you with practical advice and assistance on your personal affairs, including estate planning and liaison with your financial advisors. We deliver prompt and economical help in administration and finalisation of deceased estates, and make it as easy and speedy as possible for executors following the passing of a Will maker. We advise and guide on appropriate Wills and trusts, and any changes necessary to existing structures to ensure your testamentary intentions are followed.
Testamentary TrustsA testamentary trust is a trust created by your Will and comes into effect after your death. It gives you the ability to hold assets as part of your Will, to be paid to whomever you choose. This could be something like your superannuation balance, investment property, a share portfolio or even your whole estate.I’m a paragraph. Drag me to add paragraph to your block, write your own text and edit me.Discretionary TrustsA testamentary discretionary trust is one where the trustee has the discretion to distribute capital and income in the same or differing proportions between a group of beneficiaries nominated in your Will. The trustee may also have the ability to wind up the trust at any time.Taxation implicationsWhen the person who is in charge of your estate is executing your Will, there are several tax implications involved. This can involve superannuation issues, tax returns, and money payable from trusts. Working with a lawyer means you can identify these issues well in advance.Powers of AttorneyGiving someone power of attorney means they can legally act on your behalf, so it is something to be taken very seriously. You will need to choose someone you trust. Make sure you get legal advice before giving anybody power of attorney.Advance Health DirectivesIn Queensland, a living will is referred to as an Advance Health Directive. It is simply you outlining how you want to be cared for if you tragically lose the ability to make your own decisions.RETAIL AND COMMERCIAL PROPERTY LEASING
For your all your retail, commercial and industrial leasing needs- We are most efficient when retained early in a transaction. This allows us to ensure that our client and their agent have been able to consider all relevant commercial and legal aspects of the transaction, and reduces the chances of either party developing misguided expectations. We have decades of experience acting for hundreds of clients, from large companies to small businesses. We have a deep understanding of the issues that are likely to occur, and we guide our clients efficiently and effectively with a view to prompt closure of the transaction for the benefit of all parties. With a lack of any agreed Lease formats across the industry, anything less than a very pragmatic approach often results in inefficiencies. We are proficient in acting on both tenants and landlords (not within a single transaction of course!). We have no problems in handling one-off’s for SME’s or leasing packages for centres. We are committed to developing valuable, long-term relationships with our clients and works hard to understand their businesses and industries. This allows us to deliver accurate, timely and practical advice.

- Paul has represented the developers on numerous projects that I have been involved in. I have always found him quick to act, totally thorough with any clauses and great at following up the buyers solicitors. When other law firms are just sending emails, Paul is only too happy to get on the phone to try and sort out any potential or actual problems. On a personal note, I have used Paul Morris for 20 + years and find he is a cut above the rest in property. He started out as my lawyer for my development company and I now consider him a close personal friend.Adam Gray and Kat Iedema - SPACE Projects
- We were first introduced to Paul about 20 years ago by our Brisbane based agent to act for our clients when purchasing properties in Queensland. The advice to these clients was always very thorough and delivered in a timely fashion. If clients had any legal queries we were always very comfortable to get them to speak to Paul direct so that he could explain the specific implications for them. As the experience was so good for our clients we decided about 10 years ago to engage Paul to act for us in the acquisition of sites and to manage all our conveyancing requirements. We continue to have a strong relationship with Paul and the rest of the team at Morris Property Solicitors and would recommend them highly.Craig Williamson - Criterion Property Group
